This document outlines the corporate structure, regulatory compliance framework, lending partnerships, and statutory tax obligations of KirayaPe Fintech Private Limited.
1. Corporate & Regulatory Disclaimer
KirayaPe is a digital platform owned and run by KirayaPe Fintech Private Limited. The Company is a technology facilitator providing software and matchmaking interfaces. We are not a deposit-taking institution, bank, non-banking financial company (NBFC), or licensed credit company. We do not solicit public deposits, nor do we issue credit lines directly to the public.
2. RBI NBFC Co-Lending & Sourcing Disclosures
Any loan products, deposit financing, or credit terms provided via the KirayaPe App are underwritten and disbursed by our RBI-registered NBFC partners. The Company acts as a digital lending agent (LSP/DLA) under the RBI Guidelines on Digital Lending, 2022. Key loan terms, including the annual percentage rate (APR), processing fees, cooling-off periods, and partner NBFC names, are clearly outlined in the Key Fact Statement (KFS) provided before loan execution.
3. Prevention of Money Laundering (PMLA) & KYC Verification
To prevent money laundering, tax evasion, and transactional fraud, we strictly adhere to the Prevention of Money Laundering Act, 2002.
- Landlord PAN Mandate: In accordance with Indian tax rules, any individual rent transaction exceeding ₹50,000 per month requires Aadhaar-based KYC of the tenant and validation of the landlord's Permanent Account Number (PAN).
- Verification of Funds: By paying rent through KirayaPe, users confirm that transaction funds are sourced from clean, legal banking channels and do not represent proceeds of crime.
4. Income Tax Compliance: TDS & HRA Receipts
Under Section 194-IB of the Income Tax Act, 1961, tenants paying monthly rent exceeding ₹50,000 are legally obligated to deduct Tax Deducted at Source (TDS) at the rate of 5% (or as amended) and submit it to the Income Tax Department.
- KirayaPe auto-generates digital rent receipts and payment logs containing landlord names, PAN details, and transaction hashes to support HRA (House Rent Allowance) claims.
- However, KirayaPe does not offer official tax advisory services. Users are advised to consult a chartered accountant or certified tax professional to ensure personal compliance with tax filing and TDS obligations.
